III General information on data processing

1. purpose and scope of the processing of personal data

We collect and use the personal data of our users on the basis of legal regulations, insofar as this is necessary to provide and maintain the functions, content and services of the website. When using special services such as our newsletter, the collection and use of personal data of our users takes place with the consent of the user.

2 Legal basis for the processing of personal data

The legal basis for the processing of personal data is Art. 6 para. 1 lit. a GDPR with the consent of the data subject, Art. 6 para. 1 lit. b GDPR when processing personal data for the performance of a contract, Art. 6 para. 1 lit. c GDPR when processing personal data to fulfill a legal obligation and Art. 6 para. 1 lit. d GDPR in the event that vital interests of the data subject or another natural person require the processing of personal data. 3 Data erasure and storage duration

Personal data of the data subject will be deleted or blocked as soon as the purpose or legal obligation for storage no longer applies. Data may also be stored if this is required by law.

4 Encrypted transmission

This website uses SSL encryption (Secure Socket Layer) in conjunction with the highest level of encryption supported by your browser for security reasons and to protect the transmission of personal data, such as the requests you send to us as the site operator. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead.

IV. Provision of the website and creation of log files

Each time you visit our website for information purposes only, i.e. if you do not register or otherwise provide us with information, our system automatically collects personal data and information that your computer system transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security:

The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session. The data is stored in log files to ensure the functionality of the website. We also use the data to optimize the website and to ensure the security of our information technology systems. The data is not analyzed for marketing purposes in this context. These purposes also constitute our legitimate interest in data processing in accordance with Art. 6 para. 1 lit. f GDPR.

4. duration of storage

The data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended.

In the case of storage beyond this, the IP addresses of the users are deleted or alienated in such a way that it is no longer possible to assign them to the calling client.

An objection to the collection and processing of personal data is only possible in the case of voluntary information provided in the context of consent, but not in the case of data in log files that is absolutely necessary for the operation of the website.

V. Use of cookies

Our website does not use cookies, with the exception of Google Analytics for the analysis of visitor behavior (more information under VIII a).

VI Contact form and e-mail contact

There are several contact forms on our website that can be used to contact us electronically. If a user makes use of this option, the data entered in the input mask will be transmitted to us and stored. These data are (partly depending on the respective form)

- Company, first name, surname, e-mail address, message (free text), machine number

- E-mail address (mandatory field)

The following data is also stored when the message is sent:

(1) IP address

(2) Date and time the form was sent

Your consent is obtained for the processing of the data as part of the sending process and reference is made to this privacy policy.

If contact is made via the e-mail address provided, the user's personal data transmitted with the e-mail will be stored.

The data will not be passed on to third parties in this context. The data is used exclusively for processing the conversation.

2 Legal basis for data processing

The legal basis for the processing of the data is Art. 6 para. 1 lit. a GDPR if the user has given consent, and Art. 6 para. 1 lit. f GDPR for the processing of data transmitted in the course of sending an e-mail.

If the e-mail contact is aimed at the conclusion of a contract, the additional legal basis for the processing is Art. 6 para. 1 lit. b GDPR.

3 Purpose of the data processing

The processing of the personal data from the input mask serves us solely to process the contact. If you contact us by email, this also constitutes the necessary legitimate interest in processing the data.

The other personal data processed during the sending process serves to prevent misuse of the contact form and to ensure the security of our information technology systems.

4 Duration of storage

The data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected. For the personal data from the input mask of the contact form and those sent by e-mail, this is the case when the respective conversation with the user has ended. The conversation is ended when it can be inferred from the circumstances that the matter in question has been conclusively clarified.

The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.

5. possibility of objection and removal

The user has the option of withdrawing their consent to the processing of personal data at any time. If the user contacts us by e-mail, they can object to the storage of their personal data at any time. In such a case, the conversation cannot be continued. In the event of an objection to optional personal data that is not marked as a mandatory field in the contact forms, a conversation can be continued under certain circumstances.

To revoke the processing of personal data transmitted via the contact form or email, simply send an informal email to datenschutzbeauftragter@kuhne-group.com.

All personal data stored in the course of contacting us will be deleted in this case.

VII Analysis & social media tools

1. tracking tools

The tracking measures listed below and used by us are carried out on the basis of Art. 6 para. 1 sentence 1 lit. f GDPR. With the tracking measures used, we want to ensure a needs-based design and the continuous optimization of our website. On the other hand, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

2 Google Analytics

VIII Tools / Other technologies relevant to data protection

1. google reCaptcha

This website uses the reCAPTCHA function of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). This function can be used to distinguish abusive entries by automated or machine processing (often to create spam entries via contact forms) from entries by natural persons. The reCAPTCHA function is used in the website's contact forms.

When the function is used, the user's IP address and any other data required by Google for the service are transmitted to Google.

The legal basis is Art. 6 para. 1 lit. 1 GDPR due to the website operator's legitimate interest in preventing misuse of the contact forms.

2. google maps

This website uses Google Maps from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. With the help of embedded maps from Google Maps, we can display our location and make it easier to find us.

As soon as the user accesses a website with an embedded Google Maps map, personal data (such as your IP address) is transmitted to Google. IX Rights of the data subject

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller. 1. right to information (Art. 15 GDPR)

You can request confirmation from the controller as to whether personal data concerning you is being processed by us.

If such processing is taking place, you can request the following information from the controller about your personal data processed by us in accordance with Art. 15 GDPR.

2. right to rectification (§ 16 GDPR)

In accordance with Art. 16 GDPR, you have the right to demand the immediate correction of incorrect or incomplete personal data stored by us.

3. right to restriction of processing (Art. 18 GDPR)

Under the conditions of Art. 18 GDPR, you can request the restriction of the processing of your personal data.

If the restriction of processing has been restricted in accordance with the above conditions, you will be informed by the controller before the restriction is lifted.

4. right to erasure (Art. 17 GDPR)

You can request the deletion of your personal data stored by us in accordance with Art. 17 GDPR.

5. right to information of third parties

If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct advertising. 8. right to revoke the declaration of consent under data protection law

9 Automated decision-making in individual cases, including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. This does not apply if the decision

However, these decisions may not be based on special categories of personal data pursuant to Art. 9 (1) GDPR, unless Art. 9 (2) (a) or (g) applies and appropriate measures have been taken to protect the rights and freedoms as well as your legitimate interests.

With regard to the cases referred to in (1) and (3), the data controller shall implement suitable measures to safeguard your rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express your point of view and to contest the decision. 10.

10. right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR.

The supervisory authority with which the complaint has been lodged shall inform the complainant on the progress and the outcome of the complaint including the possibility of a judicial remedy pursuant to Art. 78 GDPR.
